Introduction

The main purpose of this paper is to understand the case of planning the opening of a coffee shop near the college campus. The initial staff of the coffee shop will be comprised of three store managers and ten coffee servers. The business loan has been preapproved by the local bank on the basis of the forecasted profit and lost statement. Before the approval of the loan, the bank has asked to submit the documents of Staffing Organizations Part 1 and Staffing Organizations Part 2. These documents are the best way of explaining the ways through which the staffing is planed and managed for the next three years of business.

The main purpose of this paper is to identify the employment relationship established between the coffee shop and employees from a legal perspective. The paper also provides the suggestions of the ways which could be helpful in avoiding the disparate treatment claims. The paper is also an analysis of the types of external influences which could hinder the staffing and the ways to address them. The paper is also related to the plan development to deal with employee shortages and surpluses along with the development of job requirements for the store managers and coffee servers in order to identify the tasks, KSAOs for those positions.

Type of Employment Relationship established between the Coffee Shop and Employees from a Legal Perspective

It is necessary for the coffee shop to establish the effective employee relationship in terms of the legal perspectives. For the purpose of maintaining the employee relationship from legal perspectives it is essential that the written agreement should be developed at the time of developing the employment contract (Keenoy, 1990). The written agreement should reflect the terms and conditions so that the promises and expectations of both parties could be met. The common law principles should be implemented for managing the employer-employee relationship in assure the minimization of the conflicts. Thus, this type of employee relationship can be helpful for the coffee shop so that the additional terms of employment could be established. It should be in writing in order to eliminate the discrepancies from it. Another type is of employment relationship to be used by the coffee shop is the development of friendly employee relationship (Littler, 1998). The coffee shop should appraise the employee for their good work in order to enhance the employee's morale.

Ways to Avoid the Disparate Treatment Claims

The coffee shop can adopt the four principles to avoid the disparate treatment claims. The first way is to provide the proper training facilities to the management regarding the legal obligations which are mentioned under the anti-discrimination laws about training, hiring functions and the proper treatment of the employees. The second way is to develop the enforcement policies through which the employees could easily conduct the ways to save themselves from the discrimination (Legge, 1995).
