Introduction

This paper has been written with regards to Employee Claim harassment and existing laws, policies and guidelines at federal state and local level for New Jersey and legal procedure for investigating and reporting.

Discussion

Harassment refers to the behavior that is deliberate and at the workplace, it can be done by the mangers, co-worker or even by the client. This has negative impact on the work performance of the individual who is being harassed. It may include sexual harassment, ethnic or gender harassment as well. Labor laws in New Jersey and Federal Employment guarantee civil rights of the employee overtime pay and benefits and also protect you against harassment and discrimination in the workplace.

Overtime Pay

New Jersey has unique state laws on overtime pay, which protect employees work long hours. As there are differences between state and federal regulations regarding the payment of overtime, employers can often do this even when this is accidental or is classified in a wrong way and therefore, employers don't pay overtime. However, labor laws differ from federal labor laws. New Jersey labor law states that the hours worked in excess of 8 hours are considered overtime and be paid one and a half above the standard hourly rates. The hours worked in excess of 12 hours are considered overtime and be paid twice the regular hourly wage. Some employees may be categorized as exempt and not entitled to overtime pay. With regards to breaks, in a day's work five hours, the employee must have a rest of 30 minutes. In one working day of ten hours, the employee shall enjoy two breaks of 30 minutes. New Jersey also has separate laws on overtime pay for employees of the computer software industry and commission employees such as stockbrokers.
