Introduction

By law, the lawyer is a lawyer whose traditional function is to defend his clients, natural persons or legal entities, in court, pleading to assert their interests and, more generally, to represent them. The lawyer performs an advisory role and acts like editor. The council is sometimes mandated by national law, notably to ensure the rights of the defence before certain courts. In the UK, the function of counsel split into two bodies: that of barristers (England and Wales) or advocates (Scotland), who argue cases before the courts; that of solicitors, attorney general, who apply legally represent and advise their clients (O'Brien, 2004). Traditionally in England and Wales, the solicitor who contacted first, and it is transferring, if applicable, the barrister who will argue the case before the court as instructed him by the Solicitor. However, the solicitor may also himself plead a case before the lower courts. This distinction between the two professions is still questioned in recent years because the solicitor advocate increasingly higher courts, as the Court of Appeal of England and Wales and the High Court of Justice. Solicitor firms recruit their own barristers for specialized business, abandoning the traditional chambers of barristers. (Amato, 2000).

Case Andrew Jones married Suzy Jones 12 years ago, when he was 28 and she was 26. They have one child together, Sophie, who is eight years old. Five months ago, He discovered that Suzy is having an affair. Mr. Andrew Jones ('AJ') has now decided that he cannot forgive SJ and wants to proceed with a divorce as quickly as possible, as he is also a solicitor by profession and his wife Suzy Jones ('SJ'). She was a solicitor but gave this job up following the birth of Sophie and has not worked since. SJ does not wish to return to the legal professionals she does not think that this will give her enough time to care properly for Sophie. so both parties are well aware of all the technical elements of the case. Mr. Jones had decided to give divorce as he is not happy with her wife and claims that she is having an affair. He also claims that she had started to drink far too much and concerned that she will not be able to look after her daughter appropriately he wishes to bring an application for a shared residence order to ensure that he can keep an eye on Sophie's care but believes she would be completely opposed to this.

Legal Requirements

As part of a divorce at the joint request, the law requires the spouses to submit their application with an agreement under which they govern themselves the consequences of divorce (see Joint compensatory allowance he entitled to pension ? become credits, property division, child residency, etc..).
