Employment, Freedom of Speech, and Political Association within Criminal Justice System

Abstract

In this study, we have explored the concept of employment, freedom of speech, and political association within the criminal justice system. It was the purpose of this study to investigate the criminal justice system in regulating and standardizing different aspects of public and society on the whole i.e. Employment, Freedom of Speech, and Political association. Criminal law has a role to play is regulating different aspects of employment. The criminal labor law indicates the branch of public law by which it protects work in all its forms through the use of criminal sanctions. Similarly the law also states that freedom of expression is one of the basic conditions for the advancement of democratic society. A comprehensive examination of such laws is conducted in this paper to get some relevant knowledge regarding different aspects of criminal justice system.

Employment, Freedom of Speech, and Political Association within Criminal Justice System

Introduction

The purpose of this study is to expand the boundaries of our knowledge by exploring some relevant and factual information related to the Employment, Freedom of Speech, and Political Association within the criminal Justices system. The criminal justice system is legalized by principles mentioned in Criminal Law. Criminal law is the set of rules that describe the crimes and the consequences (penalties) arising in a particular scenario. The rules in this law prohibit certain human behaviors (crimes), by means of a threat of a specific punitive sanction (the punishment) in order to protect the fundamental values of a people. One of the hallmarks of a civilized society is the system by which those who break the law are apprehended and punished. In order for that system to be credible, the public must be confident that, at every stage of the process, individuals are treated the same, regardless of race, ethnicity, gender, or socioeconomic status (Sutherland, 2009).

Criminal legislation and incarceration have long been used as a means to control "Powerless" and disadvantaged groups in America. These groups are socially and politically neglected and only receive attention when they are perceived to be a threat to the larger society and then the attention comes in the form of control and punishment. The control generally manifests itself through crime legislation and the punishment through incarceration. By the end of 2005, there were more than 7 million people under some form of criminal justice supervision (Stahn, 2010). Every year more than 600,000 people are released from jails and prisons to face the challenge of re-entering society in a productive capacity. Due to the collateral consequences of a criminal conviction, reintegration is often met with a host of daunting and unnecessary barriers.

However, this study is focused towards conducting a comprehensive analysis of Employment, Freedom of Speech, and Political Association within the criminal justice system.
