1- Justification for punishment

Introduction

Justification for punishment is a term that is commonly used in the courts of law. As per rules and regulations, justifications for punishment may be defined as all the evidences and just full resources on the basis of which anyone can be punished as per the nature of crime committed by him or her. As a matter of fact, in our society justifications for any kind of crime is easily available and thus punishments are given without thoroughly thinking on it. This is the reason why crime rate is increasing day by day. Therefore, it is very much important to first look at the crime, its nature and then move forward with an appropriate punishment. In the courts of law, various punishments are there for various kind of crimes. If serious crime is committed, punishment will be for sure serious and vice versa. There are four basic as well as primary justifications for the different crimes; I. Retribution, II. Deterrence, III. Incapacitation, IV. Rehabilitation. Among them two are discussed below (Gottfredson & Hirschi, 1990).

Point one

Retribution is one of the major justification normally used by the courts of law. As per this rule, every crime should be treated essentially and punishment should be given as per the nature of crime. If serious crime is committed, serious kind of punishments should be given so that in future crime rate can be decreased. Likewise, if minor nature of crime is committed, punishment level should also be minor. As per the rules and regulations defined by the courts of law, retribution is in short termed as a give and take situation where every crime is treated equally and equal level of punishments should be given accordingly. If at any point of time, any kind of serious crime is committed, the criteria of giving punishments also increases and it is very much important to first thoroughly look at the case in detail in order to negate any further issue and problem.

Point two

Another important justification is termed as deterrence. As per this justification, every crime is treated on the basis of the given logical evidences and in this scenario all the emotional and feeling part of a human being is kept aside. This is therefore termed as one of a serious justification and punishment is thus given accordingly. As per the rules and regulations defined by the courts of law, deterrence is a kind of justification which actually deals with serious nature crimes. After detailed as well as thorough research, proper evidences should be submitted in order to go for the suitable punishment. Every crime is termed as a serious one and it should be handled accordingly by keeping in mind the nature of crime.
