Impact of Globalization on the U.S. Criminal Justice System

The importance of criminal justice system cannot be overlooked in our daily lives, the presence of this system sets out functions and rules that keep people of the society safe and protected and govern them. The entire society is dependent on the criminal justice system to regulate the law and order within the society (Indermaur & Lynne, 2009). The criminal justice system has to make sure that they provide a safe and secure environment for the citizens. In order to provide a safe and secure environment for the society, the criminal justice system has to adopt the latest technologies and communication techniques which are the outcomes of globalization. Globalization has a major impact on the U.S. criminal justice system. Globalization has been able to enhance the communication and interdependence among countries of the world uniting their markets, societies and cultures, through a series of social, economic and political giving them a character overall. It has paved way to newer technologies and communication system which has improved the criminal justice (MacKenzie, 2012). The criminal justice systems are able to improve their methods of resolving crimes through the diverse technologies available with the assistance of globalization.

International Criminal Justice Systems

The international criminal system operates through complementary relationships coordination and cooperation between national and international institutions. There are various different international criminal systems. Some of them are discussed below:

Civil Law

Civil law is a set of legal rules governing the economic and moral relationship to the legitimate interests of civil rights and the organization of economic relations in society. Civil law is different from other industries in the subject, methods, principles, functions and systems. Civil law is the branch of law that combines law, responsible for the regulation of property and personal relations that arise in conjunction with property rights. Moral relations based on the principles of property status with the legal equality of the parties, their independence in terms of optimization of favorable conditions for meeting the needs and promoting optimal states of economic development and economic relations (John, 2011). Civil law is based on the equality of all members of civil procedure, autonomy and independence of their will, and their full property status.

Common Law

The Common Law was introduced in the nations of the Commonwealth to the colonial period and forms the basis of the jurisprudence of the majority of these countries. English law brought before the American Revolution is still part of U.S. law, except in the State of Louisiana, and is still the basis for many American legal traditions and procedures, although it is not applicable in case of conflict of jurisdiction. The essence of English common law (common law) is that it is created by the courts (Sampson & Scott, 2009).
