Introduction

Violence and crime are the dark side that humans love. This behavior is irrespective of age, social status, religion, gender, education, or religion. Understanding criminal behavior is a complex and different phenomenon. It is necessary to understand the multi-disciplinary approach towards criminology (Patel, 2013, pp. 1138). First part enlightens about crime and social construction with the support of psychological and sociological theories on crime. The second part talks about the nature of punishment with current policies to control crime with logical assumptions and official statistics. The third part summarizes about UK policy makers that propose counter arguments on the discussed crime.

The earliest written legal codes have recognized rape and sexual assault as crime. This essay discusses a specific aspect of rape and crime in the UK with sociological perspective. There is a limited and narrow scope of legal definition of crime. Any forced sexual intercourse that a man enforces against women as not his wife is the definition of English common law. This act of sexual assault occur with the dating partners, marital partners, strangers, heterosexuals, people of the same sex (old and young) with either women or men as victims. The legal jurisdiction depends on force as researchers, statues, practitioners as evidence on rape.

The prevalence and inescapable nature of crime experience us horrific violence and bloodshed everywhere (in this case: rape) outside our back door. Crime has no objective or accurate definition. There is value laden and judgmental biasness to the definition of crime which is rooted in critical theory of history (Lewis, 2010). A number of interdisciplinary and disciplinary fields that consist of psychology, sociology, psychotherapy, queer studies, and studies of women, philosophy and history of science, literary theory, narrative philosophy, and many others formulate a theoretical position of social construction (Gisli, 2012). The context of rape as a part of crime in different societies varies in content with exceptions (Mohan et al., 2011, pp. 1035). The whole of the society or some universal questionable human values is the representation of norms and values of a society. According to Kroeber and Kluckhohn, there is not culture that acknowledges stealing, rape, sexual assault violence, suffering, indiscriminate lying, incest, and other nature of crime. Valuing honesty and rights of property ownership, and restating sexual intercourse to nonfamilial adults are cornerstone values of the global societies (Sample & Bray, 2003, pp. 59).

Feminist Criminology emerged as a serious theoretical orientation after observing the growing pains in the society (Morgan et al., 2007). The deviance on women was credible enough for academic examination drives the pioneering generation of feminist criminologist. Understanding women as offenders, practitioners, and victims is the immense contribution of the criminal justice system. Crime and feminist studies are more ordinary to study as part of recent milestone in the disciple of criminology (Gray et al., 2011).
