Introduction

Negligence of the victim may also contribute to the accident. In some States, the negligence of the injured party will be considered to determine the responsibility of the guilty party. This is known as comparative negligence. In some States, if the negligence of the injured person is a contributing factor to the injury, then the injured person cannot claim compensation. This is known as contributory negligence. The following paper discusses the case of Mary and Charlie and their accidental case by considering the two aspects of negligence.
