Explain why this arrangement would be found “per se” illegal under the FTCs' analysis.

The Ethical Impacts of Managed care talks about the mover from the traditional systems to the managed care concept. This move was the consequence of the cost of the healthcare delivery system which was ever increasing. More than 90 percent of the organizations that provide healthcare benefits to their employees get covered under managed care. In this case, it is imperative to state that in spite of the growth in the managed care organizations and service providers, and the number of people benefitting from it, there is a need to review the practice of the service providers. When it comes to managed care, the system needs considerable improvement when it comes to the relationship between the service provider and the patient.

As per the case of the physician-hospital organization (PHO), they are having the sole entity ship, which every patient and organization is required to attain through PHO. The ethical issues that relate to managed care are no different from the issues that are faced by healthcare professionals and others working in the field. The factors that result from the managed care are certainly novel, but they are not much different in terms of their impact on the medical decision making requirements. Hence, managed care organizations need to reflect upon the current practices and weight the various conflicts of interest between obligation and bias. Moreover, there is a need to understand that each conflict is different and should be managed accordingly. There are multiple factors involved in the medical decision making. These ethical issues will not be resolved if a systematic approach is not used to manage these conflicts. Thus in my opinion, the arrangement would be found as illegal under FTC, as the rising cost would make it out of reach of the patients.

What kind of actions could be taken to restructure this arrangement to avoid a determination that it is per se illegal?
