This firm represents “Moroccan Dreams”, one of the highly reputable restaurants in Sydney. This correspondence is with respect to Mr. Kris regarding the recent state of the affair of contractual predicament resulting from the inconvenience of party. As Mr. Kris asked me to research his rights with respect to Maria, a belly dancer, I would like to bring the scenario to your notice.

Mr. Kris observed Maria's performance and offered her a position upon her verbal consent. The consent indicates the interest in performing two shows on Friday and Saturday nights in his restaurant during the Festival of Sydney Carnival in April. Maria replied that she would be delighted and requested Kris to send her the contract. A contract is prepared by Kris and contains the following terms:

Maria will be paid $250 per night.

Maria will provide her own performance clothes.

Maria will dance for 10 minutes at 7 pm, 8 pm, and 9 pm Thursday, Friday, and Saturday nights at 'Moroccan Dreams' during the 2013 Festival of Sydney Carnival.



Firstly, the revised terms in the contractual agreement caused the failure in noticing the underlying terms resulted in ambiguity (Craswell, 2000). Maria signed the contract without noticing all the revised details in the paper. This legally bounds the party, Maria, to the contract compelling her to abide the regulation in favor of the agreement. Furthermore, it was conceived that she is concerned about the additional show and the additional night as performing takes a lot of muscular activity and is very tiring.
