Statement of the relevant facts in the case

The case describes the accuser's claim on injunction to confine the offender. The relevant facts include the plaintiffs who claim to protect the copyright of the musical record that has been performed without a license by the defendant. The records which were played are "Kung Fu Fighting, House of Exile, and Money Won't Save You.” Thus, the accuser claims for damages that have been caused by the defendant. The witness exclaimed in favor of the accuser in the court that he went through a research at the premises of the defendant and found out that the plaintiff's work still being infringed at that place.

This is the statement that was put forward as a notion. It says that Mr. Hickey had identified that he is the owner of the Bar- B-Que Drive in a restaurant, he got agreed upon the fact that he listened the records which where claimed by the plaintiff himself. He also defended himself by explaining that he did not perform this intentionally to break upon the law of using copyright properties without permission. He accepted the fact that he received a letter from the accuser about stopping to use the copyright material but, due to reason that he never heard of this term in recorded. This was the fact statement that has been put forward by the defendant (West Group, 2005).
