Constitutional Implications to Protect a Citizen's Rights

This article is based on the constitutional implications used to protect the human rights of a country. The article is titled as “Constitutional Implications on Human Rights”.

The article states that the importance of constitutional implications for the human rights is a kind of individual freedom which is entitled to them except in the cases where the rights have been limited by the law. However, the European convention on human rights has provided with the human rights which are enforceable by the people.

It is a fact that the judges have to apply the laws rather than creating them. Therefore, it is necessary for them to make sure that it provides all the citizens with much power regardless of their race, gender and social classes. There are two articles which can relate to this argument. These are Article 6(1) and 14 ECHR. The Article 6(1) states that: for protecting the civil rights or obligations of any criminal charge against a person, he has right to a fair public hearing by an independent court. The judgment can be made publicly; however, the public and press should be excluded from the trial in order to prevent the moral rights and national security of the person in the society (www.lawteacher.net).

On the other hand, the Article 14 states that the rights and freedom which are being provided to the citizens through this convention should be for everyone without discrimination in terms of race, sex, color, religion, language, political, social or national origin and association with a minority. Therefore, it can be said that the above given articles protect the rights of all citizens without having discrimination on any grounds.
