Introduction

Many jurists and authors often interpret the work of policemen and law enforcement professionals with the help of textualist and originalist methods that a constitutional in nature. The concept of police or law enforcement professional was new in the era of 1789 and came into being after the passage half a century of constitution's ratification. According to Framers the duty of policemen was considered to be the job taken care of by private citizens. Additionally, few constables and sheriffs were assigned to do the supportive job and were only contacted by the citizen when deemed necessary otherwise private citizens took care of the problem themselves and this right was given to them by the constitution of America. Analysis of historical and legal documents and evidence shows that the current role of modern police is highly inconsistent with what was originally mentioned in the founding documents of the country. the concept and ideology behind modern policing has given rise to the state power which against their initial principle and laws. In the beginning when the constitution ratification just took place the sheriff was an appointed designation while constables mostly belonged to the community and it was their job to serve the community without any type of financial gains or pay.5 due to this reason they were only assigned duties related to civil executions rather than crime. Citizens were initially appointed as the caretakers of the law and were known as nightly watch officers. The job of these officers was gradually expanded and increased to catching the criminals and looking after the crime issues (Roots, 2001).

Discussion

Sheriffs that belonged to the Founding era had additional duty and job of criminal law enforcement but even then civil execution matter and cases formed major part and their job and duty.56 same was the case when professional police units were first introduced in the country their primary function and job was to look after and safeguard the safety, health and welfare of general public. The role of American police and law enforcement professional was based upon bobbie model as introduced in the England, UK in the year 1830. This model was basically developed by Sir Robert Peel who was considered as the pioneer and inventors of this model and ideology (Roots, 2001).

Criminal investigation and procedure is an important category and branch of constitutional law. The rules in this law provide law enforcement professionals and agencies with an organized framework and guidelines as to how they should undertake investigations, prosecution and deal with adjudicate crimes. There are so important restrictions that limit the scope of power and freedom of law enforcement professionals.
