Introduction

In response to the growth of illegal immigration, the first congressional effort at passage of employer sanctions came on February 5, 1952. Senator Paul Douglas of Illinois submitted an employer sanctions amendment to the 1952 Immigration and Naturalization Act on the floor of the Senate. The 1951 Truman Commission on Migratory Labor had suggested that employer sanctions might be a useful tool in combating illegal immigration. Instead, Congress passed what became known as the “Texas Proviso” as part of the 1952 McCarran-Walter Act. (Mcknight, 1998)
