Introduction

The family is a complex phenomenon that does not express all of its reality in the rule of law. The recognition of the family as a natural society emphasizes, rather, the reality of a phenomenon that is determined according to human and social matrices largely outside the law. However, the family system, even though they are entirely within family relationships shall be subject, in some ways, in legal rules, whose objective is to give a guarantee to the social content of the reports themselves. In the case of family relationships, the guarantee of the right may be more or less efficient, but in any case it means that certain interests of the individual in the family are relevant to the legal system, which prepares remedies (as possible), and on the civil and the criminal law, for cases in which the conduct of family relationships overwhelms those interests. The family is not a legal entity, or an autonomous center of allocation of rights and duties. No legal position, in fact, is attributed to the family as such. The lack of legal positions of the family responds to the lack of collective family interests: the family is not a carrier of its own interests, as the interest earned in the family is fundamental needs of the person.

Discussion

The purpose of writing this paper is to highlight the role of family law in the society. The paper basically based on a case of woman named Lucie, who facing domestic violence from her in living boy friend from she also had a child. Her boy friend Nigel treating Lucie very harshly due to which sometimes he physically knocked down Lucie and also beaten her child. Therefore, due to these tough and hard circumstances, some questions were highlighted in the case and the author tried to answer those questions and issues to its best.

Domestic Violence

The violence that pours in private and daily acts as a channeling of conflict, tension, aggression, which prevents break into the public. Family, the network of primary relationships, the space of leisure, is places of containment, individualization, pathologizing, and of course legitimate expression of conflicting feelings and frustrating. Focuses are the places where the discomfort and suffering is revealed. Where then aggression is confined and separate, private, subjectively and objectively, social content.

As mentioned before, the family is a complex system, in which individuals act, roles, responsibilities and tasks. It is a system determined by constraints of an affective type, in which they act both positive affect (such as respect, sharing, love and sexual desire) and negative affect (such as hatred, oppression, violence, the abuse and perversion). The family is, by definition, one of the areas of potential protection for its members, but if necessary it can also become a hostile and dangerous to the physical and mental integrity of persons who are part of it.
