Introduction

The word right suggests the idea of rules, regulations, and laws that affect the lives and activities of people. In primitive societies, customs, and traditions affect the conduct of its people and members States, but they still are imprecise rules and do not deserve the appellation of right. As a society becomes more and more complex, the system becomes more defined therefore it requires proper defined system comprising properly established laws, rule and regulations (Dicey, 1993, 45). Legal system means a set of institutions, government, and rules of law, attitudes and beliefs prevailing in a country describing what are right. Moreover, the legal system is the set of legal rules that are in effect with specific objective in a particular place and time. Legal system is State established or created in order to regulate human conduct or human behaviour. It comprises the set of laws, customs, and reasons jurisprudence of substantive law governing the various countries (Blackstone, 1769, 20).

Each country has its own legal system and its peculiar way of looking at the laws, customs and jurisprudence. A country's legal system is an important institutional framework through which general governance is provide by the State. In this paper I am going to describe legal system of United Kingdom specifically focusing on England and Wales. The English Legal system is very complicated and extensive thus, for this paper I have decided to discuss areas in which I have sufficient knowledge to conclude as whole from the discussion. Initially, I am going to discuss background of English Legal System and sources of English Law along with hierarchical nature of the courts in England and Wales and the extent to which the laws in England are created and interpreted by the judges. The purpose of this paper is to study English Legal system that will enable law students to learn large body of factual material about important concepts of English law, sources of English law along with hierarchical nature of the courts in England and Wales.

The English Legal System

English law is an artistic term that refers to legal system of England and Wale based in common law legal systems in the United States, Republic of Ireland, and Commonwealth countries. English law is applied in the jurisdiction of Wales and England. The English legal system has its own legal doctrine since 1189 (Beale, 1935, 55). It was originated under the inquisitorial system of England during the twelfth and thirteenth centuries and spread in the countries that were part of the British as the set of judicial decisions that were based in tradition, custom and precedent Empire.
