Introduction

In this case scenario, Susan elected as the president of the Barkhampton University. After some time, she designed an official site for the university members in which she specified a part for each of the professor and mentioned about the profile information along with the contact information on that page. Later, she met with Peter who is an owner of Barkhampton's Computer Shop. Peter gives an offer to Susan of £1000 and asked her to provide a copy of general information of the entire university member to him in order to generate his business. She accepted the offer and gave him the entire sheet. Later, Peter will be emailing each society member with marketing materials promoting his shop on a monthly basis. The community member complained about this issue to Susan. Furthermore, the university website crashed and the USB in which Susan saved all the data also misplaced. The case comes under the Data protection act 1998 and Susan is the guilty. However, all the questions are discussed in detail below.

The current case study is based on the data protection act 1998. According to this law, data Protection Act 1998 attaches to the right of access to the data being processed in accordance with Art. The right to object to the processing of data which is or, may be prejudicial to the person concerned, or a third person (Strobl, Cave & Walley 2000). The right to object is to process data that are carried out for purposes of direct marketing. This law also applies for the right that is not to be subjected to Automated individual decisions pursuant to Art. The consent, which is also, required by English law as a condition for the treatment of personal data is not provided in the body of law, as is the case for the 675/96. In this case, Susan breached the right to compensation of data protection act. It allows individuals to sue a controller and request compensation for damage caused by the non-compliance. According to this clause, members of the university have the right to sue Susan against the misuse of their general information to gain economic benefits.
