Abstract

This paper discusses cultural diversity that resulted in workplace discrimination in detail. This discrimination starts when an employee enters the organization or even during the hiring process till the termination of an employee. The paper also discusses the scenario of Maria which is related to this discussion, as she faces workplace discrimination because she is the second Native American and her accent.

Introduction

Nowadays, the workplace is becoming more diverse than ever before. The minority groups such as women, Latino and African Americans faced discrimination in United States, since more than a decade. Although, there are many laws regarding discrimination, still some organization is involved in discrimination within the workplace against minority groups. There is a huge series of discrimination problem which are imposed through negative actions and attitude of organization and individual practices and policies. Some major discrimination problems include channeling into minority positions, employment process biases, psychological and emotional maltreatment, lack of access to mentors and network, and advancement and promotion difficulties.

Universal Declaration of Human Rights asserts the principle of discrimination inadmissibility and declares that all human being are born free and have equal rights and dignity, as well as every person has equal rights and freedom without any distinction of race and sex. International Covenants on Human Rights ensure that equal right will be given to both man and woman with respect to civil, cultural, economic, political and social rights.

Workplace discrimination is the biases in the process of recruiting, job assignment, compensation, promoting and termination. However, many jurisdictions forbid employment discrimination based on certain traits. Prohibited categories of discrimination include race, gender, creed, language abilities, disabilities, sexual orientation, marital status, ethnicity, pregnancy, political affiliation, citizenship, age, and gender identity (Todorova et al., 2010).

Instead of discrimination regulation to avoid discrimination in the workplace, bias is still out of control. Women are not considered equal to men when it comes to rates of employment, income and occupational range. The average salary of women is 72 to 88 percent of men, and also at variables like age, job tenure, education, and level of position are considered. According to Catalyst report, in the Fortune 500 companies, only one in eight women was CEO. Women were stuck in low wage jobs but more protected positions (i.e. healthcare and education). It can be witnessed in history; the employment rate for women was comparatively low.

The cultural factors of Maria include family engagement and group orientation that also contributes towards discrimination, as these factors comes in conflict with her cultural values. U.S. Civil Rights Act, Title VII evidently prohibits an employers' discrimination against employees of color based on customer and personal preference.
