Constitutional Matter

First there will be description about the Articles of Confederation and then the US Constitution. Before the Constitution of USA was drafted, there was The Articles of Confederation which came into effect as it was called the first constitution of the United States. It was prepared in 1777 by the same Congress that passed the Declaration of Independence. The establishment of the “firm league of friendship” among the thirteen states took place with the help of these articles. It was produced during the Revolutinary war and it reflected the strong position of the central Government. (Hall, 112)

Although, there was a fear that the individual would not be given much attention by the national government who is having lot of power, so there the Artices proposed the development of Constitution which would provide maximum share to the individual states. When the articles were there, the states were able to retain their "freedom, sovereignty and independence”. There were no setups of executive and judicial branches of government, but there was a delegation comprised of representatives from each was a a national legislature called for by the Articles. The responsibilty of Congress was to conduct foreign affairs, declaration of the peace or war and preserving an Army and Navy. However the Articles did not allow Congress the authority to collect taxes, enforce laws and promote commerce. Ultimately, it was realized that these insufficiency would lead to the adoption of the U.S. Constitution. However, during that period when the thirteen states were facing problems to achieve their independent status, the Articles of Confideration kept them in good position. The Artciles of Confederation was adopted by Congress on November 15, 1777 and then the articles became operative on 1st of March, 1781 when the last of the thirteen states deicded to sign the document. On the 14th of May, 1787, The Federal Convention called on a meeting in the State House, that was known as Independence Hall, in Philadelphia to revise the Articles of Confederation. Due to the presence of delegation from two only states, members held the meeting daily until the presence of seven states which took place on 25th of May. It became clear by mid-june after the the lengthy discussion that rather than amending the existing Articles, the Convention would prepare an entirely new frame of government.
