Background

The principal issue in the case of Matimak was whether for alienage jurisdiction's purposes of alienage jurisdiction, a Hong Kong corporation is a “citizen or subject” of a “foreign state. It was decided by the court that Hong Kong is not recognized by United State as an independent and sovereign international entity. In view of that, Matimak was not let appeal to alienage jurisdiction as a Hong Kong's “citizen or subject”(August 2004).
