Abstract

In this study we try to explore the concept of search warrant in a holistic context. The main focus of the research is on search warrant and its relation with security and compliance of law. The research also analyzes many aspects of search warrant and discusses various aspects such as when it is needed and how it can be obtained. Finally the research describes various factors which can help police and other intelligence officials to get the search warrants.

The Search Warrant

Introduction

To provide security and protection is the main ambition of the police and other intelligence officials. In order to fulfill this purpose police and intelligence officials keep their eyes on suspected individuals. In order to address the quest of their curiosity these officials often need to go in the depth of the search. For this purpose these officials perform the search operations. While performing the search process for detecting any criminal and suspected activity these officials should maintain and follow laws, rules and regulation. In order to be the process of search in a fair way that also maintains the privacy and dignity of an individual law has devised the phenomenon of search warrant. The main objective of this paper is to talk about search warrant from variegated perspective.

Search Warrant

A search warrant can be described as a document. This document is issued by an authorized judge to the police officers. This warrant is issued to the police officers so that a search process related to any material or object can be conducted at any given location and time (Paul and Sara, 2011). The search warrant is issued when there is reasonable suspicion in that location to find evidence of illegal activity and must be ordered by a judge to preserve the privacy of the individual. For instance, if a police officer is investigating about a case of bets about horse racing then a search warrant related to this would be as follows:

“The officer is authorized to search Happy Glade Avenue, between 8:00 am to 6:00 pm. The officer can search for slips of betting, record books, slips and any other objects that the officer may find in connection with betting activity (Paul and Sara, 2011).”

How Do Officers Obtain Search Warrants

In order to get the search warrant from an authorized judge or magistrate the police officer needs to present all the gathered information in front of the judge related to a case. This information is presented in front of the judge in the form of affidavit and written statement. This information is usually gathered by the police officials, private citizens and undercover informants of the police. In most of the areas, a judge or a magistrate almost remain available for the twenty four hours for the issuance of warrant.
