Yes I would agree to Antonin Scalia's view as in one important case that Judge Scalia ruled a concurring opinion upon was the case Texaco v. Hasbrouck in 1990. The case involved the mega-gasoline distributor, Texaco, its direct respondents, and two distibutors, Gull Oil Company and Dosier Oil Company. Texaco was selling its gasoline directly to its respondents and several other retailers in Spokane, Washington at retail tank wagon prices (RTW), while it granted two distributors, Gull and Dosier, a discounted price averaging around four cents below the RTW.
