Abstract

Hospitals must comply with the federal and state laws for providing care to patients. In this research paper, brief case of Mr. James and Mr. Olson is discussed who violated the federal laws of patent's care. This research paper focuses on different medical laws and principles that government enforces. The possible defenses are suggested for Swedish hospital and Grinnell Hospital.

Introduction

The health care industry is the service provider industry whose main emphasis is on the patient's health and care. Therefore, hospitals must comply with the medical laws, rules, and regulations in providing medical treatment to patients. Several ethical issues arise that develop contradictions and conflicts between the patient and a physician. The law implements certain guidelines, code of conduct, and policies for treating the patients belonging to different backgrounds. The medical law states that there should be no difference between a black patient and white patient, poor patient and rich patient, etc. All the patients hold equal rights and a physician are liable to give fair treatment and services to the patient regardless of his cultural background and wealth background (Katz & Paul, 2002). The physician withdraws from the duty when a patient fails to pay for the treatment; patient fails to take the medication etc. there are four main objectives in the medical law that the hospitals must focus on; patient-doctor relationship, doctor-doctor relationship, doctor-hospital relationship, and doctor-society relationship. The Swedish hospital and Grinnell hospital comply with the federal law, state law, and local rules. These hospitals ensure that their departments also comply and work according to the federal law, state law, and local rules.

Simon (2003) examined that the law of medical is significant in regulating the hospital. These laws benefit the patients. It is the duty of a physician to comply with the ethical laws and rules to provide fair services to patients for their protection. The utmost duties of a physician are to provide competitive care services to patients and to secure him from the legal problems by following the medical rules. There are several ethical and legal issues. First, lack of confidential information of the patients is a legal as well as an ethical issue. If the personal information of a customer lacks from the record of a hospital it is an ethical and a legal issue against which a patient can file case on the hospital administration. Second, the physicians do not treat the poor person which is unethical behavior of the patients. In U.S., there are numbers of poor Americans who cannot avail the medical services because of poverty. Third, the use of old instruments and surgical tools are a legal issue, and if any patient suffers from it, he or she can sue the physician.
