Introduction

The American justice system is a highly complex entity, which influenced by various factors. The ideology behind the criminal justice system is to ensure that the constitutional rights of civilians ensured, and the adequate actions taken against the criminals. The Two theories explained by Herbert Packer represent a detailed view on the American Justice system. The Due Process Model and the Crime Control Model represent the predominant ideologies behind the American justice system. These theories are different in their approach to cope with criminal activity, and developing a positive legal environment. Although the central goal of both these theories is to ensure that the criminal activity in the country minimized, and law abiding citizens achieve the right to lead a peaceful existence, the dynamics of these theories are highly differentiated. The purpose of the article was to represent these two ideologies driving the American justice system, and their implications on the overall society.

The synopsis of the article has been on the analysis of the two mentioned Justice System ideologies. One justice model based on the process orientation, where the emphasis laid on the dynamics of the process. The other based on the human element and issues in the information acquiring process. Crime is a highly negative and stressful entity due to which the relevant persons are not able to provide the accurate account of the events.
