GREY V COLIN- TRESPASS OF PROPERTY

Colin was charged by our client Ms. Grey for trespassing her property. She went on a visit to Fraser Island, and had given the keys to Mr. Colin to look after her house known as “Ocean View” whilst she was away. Ms. Grey has a boat that she uses for her personal use. Whilst she was away, Mr. Colin used the boat for his leisure, and was found with bottles of beer. Upon demanding an explanation from him, he mumbled something about a storm and an emergency. During this time, Mr. Grey's other neighbor was also present in the neighborhood, and had seen Colin sailing in the water with Ms. Grey's boat. In addition to this Colin damaged the boat and it sail. The question that arises are:

Is Mr. Colin liable for the damages to the boat, when he was looking after the property?

Was Mr.Colin a good neighbor and Ms. Grey entitled him to look after the property because of this?
