Negligence is the most common civil suit filed against doctors. Liability for negligence will not be established except the following factors are found (Polan, and Polan, 2005): (a) the defendant must be obliged a duty to the plaintiff to work out care; (b) the defendant should violate the standard of care recognized by law for his/her behavior; (c) the plaintiff must undergo loss or injury as a consequence of this violation; (d) the conduct of the defendant should be the 'proximate cause' of the plaintiff's loss or injury.
