Introduction

The paper will discuss the case mentioned in which discusses the case of negligence where the Board of Directors of their liability to both the gymnasts and weight lifters.

Tort Law

Tort is defined as the area of law which aims to provide remedies for civil injustice. It is considered as a civil action where one party can claim against other for civil injustice. Negligence is one of the principles of tort law in which neglect is punished by awarding compensation to the victim. Negligence can also include some cases of strict liability and intentional harm (Nolan, 2007, p.nd).

Negligence

Negligence can be defined as the most common kind of conduct which is below standard and is required to protect others from risk of harm. Negligence can occur at work, on road, in a professional capacity or any other situation during which care is obliged from one party to another. When the duty of care is established any duty resulting in financial or personal injury belongs to the tort of negligence (Wright, 2001, p .nd). The elements which determine then liability for negligence are:

The plaintiff was owed a duty of care on the basis of special relationship or some other principle

Failure or breach of that duty

The injury was caused directly

The plaintiff suffered injury as a result of that breach

Damage was not too secluded, but there was immediate cause which showed that the breach caused the damage

Negligence in relation the case

The case discussed can be considered as the neglect which occurs when one party can do whatever is necessary to prevent injury or damage to a client. There are two common types of negligence, medical and legal. Negligence law defines the obligations in business should be remembered when dealing with clients. It also protects the rights of clients and cares for professionals.

Law handles legal negligence claims against a business which has been accused of committing an unlawful act against a client. In this, case the Board of Directors should be advised about their liability to gymnasts and weight lifters under the tort of negligence. The court legal standards are expected to adhere to as well as certified in providing legal advice against negligence.

There are certain deadlines for filing negligence. If a person fails to file a negligence suit within, loses the right to collect assistance for injuries. Law of limitations for legal negligence is one year from the date of discovery of the damage (Wright, 2001, p. nd). Many consumers are under the assumption that a procedure or court case that was not resolved in their favor will be grounds for filing a negligence suit. In many cases, there is no assurance that a transaction will be 100 percent effective, or lawsuit will succeed. As a result, it is unreasonable for a consumer alleging negligence in business.
