Introduction

Protection right of every individual is focused by 14th amendment that is under the procedural law. However, the right of citizens to vote was denied or abridged due to previous condition of servitude, color or race but still protected by the 15th amendment. Whereas, all rights are reserved by the 10th amendment to the individual states and not exclusively granted to the federal government. The article 4 of the constitution guarantees the right of self-government for each state. The 1965 civil rights act was passed in order to respond to the voting discrimination that was present since a very long time in history.

The section 5 of the Constitution prohibited the eligible districts for making changes to their election procedures and laws, without gaining official authorization. For the presidential election of 1964 that turnout less than fifty percent and had a voting test is the place as of 1 November, 1964 as the eligible districts, were defined by the section 4 (b) of the Constitution (Walsh, 2013). Based on minority status or race, any individual's right to vote will not be negatively impacted, and it will not have the effect or change the purpose of the three-judge panel or the attorney general of a Washington, D.C. district court. For five, years, section 5 of the Constitution has been continually renewed since that time and was originally enacted.

A permanent injunction against the enforcement of section 4 (b) and section 5 of the Constitution was held. However, Shelby County, Alabama that sought both a declaratory judgment filed a suit in district court. Summary judgment for the Attorney General was granted, and the constitutionality of the sections was upheld by the district court (The Oyez Project at IIT Chicago-Kent College of Law, 2013). The issue of voting discrimination is still relevant, and by reauthorizing section 4 (b) and section 5 of the Constitution, authorities were surpassed by the congress, and this was upheld by the court of appeals for the District of Columbia circuit of the court of the United States.
