Abstract

The paper aims to describe the ICTY role as judicial institution, and the affects of its decisions to the international and the local stakeholders of the Yugoslavia. The paper argues about the institutional, political and other necessities inbuilt in the nature of the ICTY. The paper helps to define the powers of the ICTY that the institution is autonomous and don't have to respond any primary authority which can affect the interests of the former Yugoslavian. This paper also gives an idea about the rules and procedures followed by the ICTY for taking any legal action against any official authority involved in the war crimes. Introduction

The international criminal tribunal for the former Yugoslavia abbreviated as (ICTY) is a United Nations court of law it deals with the crimes which takes place during the war. Many war crimes took place during the conflicts of the Balkans during 1990. After the establishment of the court in 1993 the things have changed permanently, foundation of the ICTY provided the landscape and platform for the international humanitarian law and it also gave the opportunity to many victims of the crime wars to raise their voice against the fear and horror they experienced and witnessed. Most of the prior decisions of the court tribunal include the problem settlement of the genocide, war crimes and criminal activity against the humanity. The Court has shown that the reference or any senior position cannot stop the verdict took place against any crime. The court was very effective in maintaining the consistency in prosecution without any hurdles.

This type of response against the war crimes has shown that the one that have been suspected needed to bear the great responsibility for killing, atrocities or commitment can be called into an account. If the guilt is identified against any individual than certain, will be taken for protecting the entire community previously there was a common practice for labeling the whole community as a collective responsible. The idea of convicting responsible individually eliminated this phenomenon. Not only this the International Criminal Tribunal for the former Yugoslavia successfully laid the foundation, which is now accepted as a trend for conflict resolution and the development of the post conflict development across the world. Many leaders who were suspected for the mass crimes faced the tribunal justice system against their treacherous intention resulted in the provocation of the war crimes. After the Existence of the Criminal Tribunal, (ICTY) it has been proved that efficient and transparent international justice system is possible. For the success, of this aim and objective tribunal has contributed with many initiatives and therefore, it resulted in the maintenance of the indisputable historical record.
