Sexual predators are those people who commit sexual crime and hunt down their prey for rape or child sexual abuse. Florida has laws to prohibit such conducts. The Florida Department of Law Enforcement caters to the sexual offenders and predators, charting a course (Singleton, 2006). The Florida's Sexual Predator's Act helps protect the innocent from such crimes. They are defined by the legislations according to the specified sex offense. These offenders are registered with the local Sheriff or the state and the department of Safety within the 48 hours.
What types of crimes are codified into law, misdemeanor, or felony?
The laws that are specified for Florida's sexual predator are the one that comply with the registration law (Boston, 2004). They are codified as “one is enough” (which is committing after or on 10/1/93) and “second offense” (which is committing the sexual offense the second time, after being caught at the first time.)
“One is enough”
The section 775.21(4) deals with the offense conviction that was committed after or on 1st October, 1993. This is the violation of any life, first degree felony or capital of Chapter 794 (Sexual Battery).
One is 18 years or above attempting sexual battery (that is harming sexual organs) on a 12 year old or less victim is a capital offense.
18 years or less of age person attempting sexual battery on the 12 years or less age victim is life felony.
Attempt of sexual battery on 12 years or above this age without the consent of the victim and physically forcing also using dangerous weapon to harm thus resulting in personal injury is a life felony
When a 12 years or older victim of sexual battery is helpless to physically resist, threatened or forced while the victim presumes the offender is able to execute is the first degree felony.
If the offender is mentally defective and that is known by the victim is first degree felony
