Respondeat Superior doctrine implies that the actions of subordinates meet their immediate superior.

Introduction

Respondeat superior in a Latin phrase which can be translated as "let the boss answer". This doctrine implies that the actions of subordinates meet their immediate superior. It is mainly used when an employee causes harm to another person or entity, and not just one employee it may be a case of collective harm. In this case, there is vicarious liability of the employer or supervisor for the consequences of flawed actions of a subordinate or employee (Giliker, 2010). This is the concept that the responsibility for the safety of employees rests with the employer. The legal term is commonly used in ELL demands. It is also interchangeable with Vicar Responsibility.

Discussion

In many cases the principal or employer is responsible civilly and may be prosecuted. This is the main employer or is liable even if not at fault and not personally guilty of any evil. This concept of imposing liability for the fault of another is known as respondeat superior (Giliker, 2010). The situation occurs when both the employer is an employee and the principal has an agent who committed the wrong. The rules of law governing the vicarious liability of the contractor and the employer are the same. It is to remember that these rules also apply to agents acting within the scope of their authority. For example, the vicarious liability of a seller for the false statement made by a sales person only arise when the seller has appointed an agent to sell.
