Introduction

Recidivism refers to the criminal law situation where the same offender re-commits the crime after having been lawfully sentenced for committing the crime of the earlier. For recurrence is irrelevant whether the previous conviction was for negligent or intentional criminal act. The only exception to this is the especially dangerous recidivism, which is possible only for particularly serious intentional crimes (A, 2008).
