Patrol Pursuit Policy

Abstract

This paper includes the case about the Patrol Pursuit that held in Georgia. It is the policy of the Pursuit Patrol agency to protect the lives of people in mass while initiating the pursuit. In the policies of Hillsborough County Sheriff, the deputy has consider factors such as the condition of the roads, congestion in the traffic and charges that are in pending, usually in day time. The patrol supervisors are responsible to conduct and continuation of a vehicle pursuit, and he has the authority to whether continue or discontinue the patrol pursuit at any time when the patrol supervisor wants. Plaintiff criticized department of Florida that the agencies must adopt restrictive policies in pursuit. To win the lawsuit it is important for the agency to follow four steps; explain the initiative clearly; use statistics; 3.Show the existence of departmental training and control; and hire external pursuit expert.

Introduction

This paper is about the Patrol Pursuit policies including the verdict of the Supreme Court in the case of Georgia pursuit. Furthermore, this paper includes the policies of Florida Highway Pursuit and Hillsborough County Sheriff along with the liability and Patrol pursuit policy. In the end of the paper, recommendation to win the case is presented comprised of four steps.

Discussion

The Supreme Court of the United States of America has lately given a decision on a Georgia pursuit case where the deputy crashed into the passing motorist that left the suspect a quadriplegic (Yates, 2007). The party who was injured has claimed that the deputy used force with extreme power that was on the basis of unfair attack under the 4th Amendment. The court gave a verdict on the act that the police officer has attempted to stop a furious care chase that was on high speed, which made threat to the lives of other innocent bystanders does not breach the 4th Amendment, even if it creates a risk of furious motorist with the risk of death or severe injury. The court gave a verdict and blamed the escaping motorist suspect and said that the court is reluctant to lay down a rule that required the police to allow escaping suspects to run away at any time because they drive so irresponsibly that put lives of other innocent people in danger. It is clear to create such a rule to vicious incentives, and that incentive is directed towards “escape” (Yates, 2007).

Florida Highway Patrol Pursuit Policy

It is the policy of Florida highway patrol pursuit that the escaping suspects put several lives of other innocent people in danger in vehicular pursuit (Hudson, n.d.). The Division is responsible to protect the lives of people who are in danger while enforcing the law, and to protect the lives of people they must go to the every possible extent, which is a part of the policy of highway patrol pursuit.
