Introduction

In the case of Giovanni and Cherry Pertucci, we can say that a profession is an occupation requiring of the arts of sciences and advanced study in a specialized field, such as the law. It most cases it requires a specific standard of mandated field of study. In today's standard of a paralegal is defined as: A person sufficiently trained or experienced in the law and legal procedures to assist, under an attorney's supervision, in the performance of substantive legal work that would otherwise be performed by any attorney. This definition is however lacks a certain accuracy, because in addition to all those things a paralegal is also a professional. Giovanni was born in England but his parents are from a small village in Sicily. He is a self-employed barrister. This status however controversial has not been granted because of the lack of mandatory statutes requiring a license. The time has long since passed when a paralegal could enter the profession without formal education.

Currently many employers prefer paralegal candidates with the following background: (1) a bachelor degree from a four-year institution; (2) paralegal training, preferable from an ABA approved paralegal program; and (3) hands-on practical and work related training such as that obtained through an internship or externship. However, many are contemplating the further requirement of a license. By their very nature, licensure mechanisms are designed to protect the health, safety, and well being of citizens. She fell in love and began an affair, and has found that her life is so much happier with him than the lonely existence she had with Giovanni. Eduardo is her priority still, but feels that as a boy he will need his father more and more as he grows. She wants Eduardo to have his base with her, in the matrimonial home, seeing Giovanni regularly and frequently.

Many people think that mediation is an informal process, in which a friendly mediator chats with the disputants until they suddenly drop their hostilities and work together for the common good, in fact, mediation is a carefully designed process designed to get results. How we get these results is the reason we are here today.

To me mediation is an art, an art demanding the utmost in human relations skills. It is also becoming an increasingly important art. The need for skilled mediators in our society is increasing.

Most of what a mediator does is part of two simply stated tasks: (1) helping to define problems, and (2) aiding in the solution of problems. The things a successful mediator does to accomplish these tasks, is what we are going to talk about: strategies. But, keep in mind, that a given strategy may cause failure at one time, but may bring success at another.
