Introduction

This assignment is based on analysing four law-based extracts on the basis of their errors in academic writing styles, grammatical errors, spelling mistakes and referencing and citation issues. I will assess each extract given, and then will remove the errors from them. In the end I will re-write the extract, free from any writing style or grammatical mistakes whatsoever.

Extract 1

Comments and Views on shortcomings of the Extract

In the context of analyzing this extract by the title “What is a legal system?” I identified many mistakes of spellings, phrases and grammar. The article is a sound presentation, but it made use of some clumsy or inappropriate phrases that undermine its effectiveness as an authentic text passage on the subject. The article is expected to be describing the components of a legal system but instead, it refers to provide a distinguishing aspect of a legal system from a law which may not be appropriate or any useful. The first statement of the article, for example, is totally inappropriate and made a poor use of the chosen words and phrases. The standard style of academic writing is missing in parts of the article, where the author could explain himself in a better and more professional manner. (See appendix for the highlighted mistakes of grammar and spellings).

Re-writing the Extract

A legal system is a system that sorts out the law and simplifies it by breaking down into rules and regulations. A law is always present, but it needs to have a system whereby the law can be passed properly and the cases of the law courts can be decided by the judges. In other words, a legal system represents formal machinery for passing and enforcing the law; and resolving the legal disputes. It is thus, more concerned with the law's processes and institutions, rather than its substantive rules.

A constitution is all about governments, politics and similar other matters, whereas a legal system relates to the system of the law including courts, judges and barristers, appeals and tribunals, legal aid and solicitors. All these factors make up a legal system and regulate the execution of law in a better fashion. Moreover, a legal system is a way through which individuals achieve fair justice, because the constituents of a legal system work closely to ensure an access to justice, fairness, and fair trials. In conclusion, a legal system is neither a law nor a constitution; it is a system for the law (Austen, 2002, 230). Without a formal legal system, individuals cannot have a proper law in the country.

Views on shortcomings of the Extract

In the extract “what is a contract”, the author has made a few spelling mistakes that have wrongly altered the basic meaning of the sentence altogether. The first line of the extract is also faulty and could be rephrased for a correct use of the language and writing style.
