Human Trafficking and the Smuggling of Migrants

Introduction

The aim of this paper is to identify if there is any difference between migrants smuggling and human trafficking. It aims to provide a clear distinction and difference between both, smuggling of migrants and human trafficking. Both of these terminologies are often used interchangeably with one another. However, it is important to understand that they are not same. There are number of differences and distinctions that exist between these terminologies that will be discussed in this paper.

According to UNODC (United Nation Office of Drug and Crime) (2011), the topic of smuggling of migrants has gained significant attention of the public and media around the globe. However, there has not been sufficient analysis on the topic. There is a need of providing expert information and knowledge in order to eliminate the confusion prevailing regarding the migrants smuggling in an international perspective of migration (irregular). According to the report of FATF report (2011), increasing evidence has been found to conclude that the human trafficking and migrant's smuggling are some of the most highly earning illegal businesses. It is not always easy to differentiate between human trafficking and migrants' smuggling in most of the cases.

The human smuggling is referred to a phenomenon in which transportation, facilitation, or intent transportation of human takes place illegally across the global border, along with violating one or more laws, either through deception or clandestinely. They people are also likely to become victims of other criminal activities. They are also victims of physical and sexual harassment (Department of State, 2013).

Human Trafficking

The human trafficking is defined as those acts that are transporting, harbouring, recruiting, transferring or includes receiving the person through the usage of coercion or force and any other means that are related with to the mean of exploiting them (FATF report, 2011). According to the international organization of labour this is estimated that there are around 21 million people that are consist in youth and women are affected with trafficked each year and thus made this issues as the global problem. There are some forced of laboured and other form of servitude the trapped in the prostitution.

The number of publications and studies are escalating as the awareness of human trafficking is increasing at an international level (Brunvskis, 2005). Human trafficking is the commercial trade of people for several purposes most commonly the extraction of tissues or organs, forced labour, of sexual slavery. The United Nations Convention against Transnational Organized Crimes (CTOC) is one of the primary body setup to stop human trafficking and facilitate other nations in protecting the victims and prosecuting the traffickers.

The trade of humans is a very lucrative business since the demand is very high and constantly growing while the risks associated with this business is quite low.
