With regards to the case, the main material facts that have been collected have been mentioned below.

By section 5(1) of the Act of 1988 it is an offence to drive a motor vehicle on a road after consuming so much alcohol that the proportion in his breath exceeds the prescribed limit of 35 microgrammes of alcohol in 100 millilitres of breath.

Lion Intoximeter 3000 is a device approved by the Secretary of State in order to measure the content of alcohol by the use of an analyzer. Measurement takes place with the help on electrical signal, a computer which converts it from digital form to visual display to get the results of the test.

Result of the test is shown after which it can be printed by the use of a printer.

Breath stimulator provides air containing a measured quantity of alcohol so that the constable that operates the machine is able to check the calibration correctly.

The case is about Ms Tick and it took place in May 1993, when she drove on the Chester Road after which she was arrested because of high speed. She was then taken to the Sun Hill Police Station, and after this, she was made to take the breath test by the use of Lion Intoximeter 3000.

The legal issue that persisted in the case was that Ms Tick was driving at a faster speed that is allowed. Therefore, she was arrested at the Sun Hill Police Station after which breath test was conducted. In every country, the citizens are not allowed to drive at a higher speed that has been allowed to them. Therefore, any individual who increases speed can be arrested after which he or she is entitled to pay fine and may also result in imprisonment. In this case, Ms Tick drove faster than the speed limit which is itself a crime, however when her breath test was conducted, it was discovered that she was drunk. It is also not allowed to drink alcohol and drive because it is extremely unsafe. This rule has to be followed by everyone in order to ensure road safety of the people and also the driver who is driving the vehicle.
