Introduction

All over the world, there are many landlords who have provided their property or land to tenants on lease. Lease is the agreement between tenant and landlord, which helps the landlord in transferring the possession of property to tenants. The Landlord and Tenant (Covenants) Act 1995 helps in building a legal relationship between the landlord and tenant. It helps in simplifying the agreement and providing both parties with their rights and authority. The purpose of the Act is to create a balance of rights and authority between both the landlord and tenants. This paper discusses the extent to which the Landlord and Tenant (Covenants) Act 1995 maintain a balance between the respective abilities of a landlord and tenant to enforce the terms of the lease (Goddard, 2010).

Lease

Lease is the legal contact between the landlord and tenant, which helps in transferring the authority, possession and use of property to the tenant. Both the parties make an agreement on some terms and policies, which helps in building a legal relationship between the landlord and tenant. If the landlord or tenant act against the law or lease signed by them, they have to bear the consequences. The landlord or the tenant can sue the other party in case of breach of lease. The Landlord and Tenant (Covenants) Act 1995 provides both the landlord and tenant with the right and authority of litigating the other party if they go against the agreement.

The Landlord and Tenant (Covenants) Act 1995 was enacted for the purpose of highlighting the liability of former tenants. The Act simplifies the law and agreement between the landlord and tenant. The different sections of the Act present the right of Landlord and Tenants on the land and property. When the landlord gives the tenant his land or property to live, they sign a contract or agreement, which is known as lease. The terms and policies of the contract are clearly mentioned in the lease, and it is the responsibility of the landlord and tenant to follow the agreement. The purpose of the Act is to create a balance of rights and authority between both Landlord and Tenant.
