ABSTRACT

Cyber crimes have been increasing with the advent of technology and with the implementation of internet in the companies. It is important for the government to make sure that the people and the companies work according to the rules and regulations set out by the legal system of the country and that they help the economy to succeed. For the same reason, the government implemented changes in the technology act of the country so that they could work for the betterment of the people and that aspect such as privacy are included so that the business can be carried out in a fair manner. The pros and cons of the amended technology act will be discussed in this paper and will present as to how effective it has been for the country.

INFORMATION TECHNOLOGY (AMENDED) ACT 2008

Introduction

Information Technology Act is commonly known as ITA-2000 and was passed by the Indian Parliament. The main aim of the Act is to ensure that legal recognition for the transactions that are done over the internet and the exchange of data electronically should be monitored for security purposes. The act helps the people in understanding what measures they should take while using the technology in their daily lives, especially for their work purposes. With the increased use of technology for work and business purposes, the government of India felt the need for introducing an Act that would help the country in ensuring that the business that is being carried out is in favor of the business community, as well as, the country. This paper will discuss the amendments brought into effect in the Information Technology Act along with a critical analysis.

Previous Work On The Topic

After the increase in the criminal activities and terrorist attacks, the country was left with no option, but to make sure that certain amendments are brought to this act as technology is used by the terrorists, as well. A major incident that caused amendments in this act was the Mumbai Attacks that occurred in 2008. Many news reports show evidences that cyber communication was the main source of communication for the terrorist in carrying out these attacks [1]. The two main aspects of cyber terrorism i.e. gathering of information and spreading terror by means of cyber communications were seen when the terrorists decide to attack the city or the country. Keeping in view the increase in the cyber attacks and the use of technology as a communication medium between the terrorists, the government of India decided to bring into effect the proposed amendments that would help the country in combating cyber crimes and control terrorist activities that are carried out using technology.
