Introduction

The crime of Genocide is considered as an international crime and all those who are found guilty of committing this crime may be punished by the International Criminal Court (ICC). As per the definition of genocide , it involves either one or all of the following:

(a) Assassinating individuals of a particular group

(b) Inflicting life threatening or fatal injury to individuals of a particular group

(c) Intentionally causing mental injury to individuals of a particular group in whole or in part;

(d) Applying various methods and procedures to control birth rate

(e) Transferring young adults from one group to another group by force.

There are a number of concepts to study these acts and we shall discuss it in the light of different theories which may be helpful in understanding the subject.

Subjectivism

Subjectivism is one of the philosophical theories that basically relates to the person's mind or subject with which he or she is born. It revolves around the approach which the individual takes about his or her position either in the world order or in the knowledge of that order. This approach of the person is linked to sensations, ideology, attitude, emotions, beliefs and feelings. This subjectivist theory is of substantial importance in a number of disciplines in the field of philosophy like theory of knowledge and value theory.

Existentialism

Existentialism is fundamentally associated with history of intellect having the predominance of historical convenience in-built in its definition. It can therefore be defined as the philosophical theory that takes hold of existence of human being under some defined categories which are controlled by the norm of authenticity (Warburton, 2010). The theory lays emphasis on one hand on the core ideology that one cannot practice philosophy in an indifferent manner of an objective science but on the other hand it does rely on the well known themes of dread, boredom, alienation, the absurd, freedom, commitment and nothingness.

Utilitarianism

Utilitarianism is basically a planned, well thought of, conscious attempt to provide answer to a pragmatic question as to “What should a person do?” The answer is fairly simple for any sane person that the individual must act in such a way to produce the best possible outcome. The sequlae under the concept of Utilitarianism include all the good and bad produced by the act. The end results produced in this manner may either arise during the performance of the act or after the act has been executed (Leibniz, 1996). To some Utilitarians, the option between them is not of significance morally if the difference in the upshot of substitute acts is not enormous.

According to Mill (2010), an act must be categorized right or wrong, or in other words justified or unjustified, on moral grounds only. He further elaborated it that the element of agent compulsion needs to be considered by the person rather than the factors of persuasion for the execution of the act in the preferred approach.
