The definition of marriage by Lord Penzance can be found in Hyde v Hyde (1866). He defined marriage as “The voluntary union for life of one man and one woman to the exclusion of all others”. There are a few formalities which are required to be fulfilled in order to make a marriage valid. These formalities are required for reasons of proof, avoidance of deception, public record, certainty, solemnity and consent.
