Introduction

Gay marriage is the marriage that involves two people of the same sexes either a man and a man or a woman and a woman. It can also be seen as the term that is used by the government, the social groups and religion to have the recognition of the marriage between two people of the same sex. There is a social movement so that people can obtain their rights and responsibilities in countries like the US. The legal issues that are involved in this type of marriage have been made strict by the federal system of government in the traditional, the federal government had no attempt to have meaning of marriage and therefore there was the notion that any marriage that was known by the state was also made known by the federal government even though there was a problem for the recognition of these marriages by the other states.

This means that the state was liable for enforcement of the rights that the people require so that people can have their partner through the law. With the act of defense of marriage then the people found it easy on how to go about the problems that were to be encountered and this could only work, and it made the definition that marriage could be a union of one man and one woman. Therefore, there is no agency that has the recognition for this same sex that people have forced for the legalization of the type of sex.

Utilitarianism Ethics

Stuart and Jeremy Bentham are the founders of the utilitarian school of thought in ethics and morality. Utilitarianism is a normative ethical theory which remains concerned with the maximization of “utility” (happiness) and the minimization of pain. According to Bentham (1970) the pursuit of pleasure and prevention from pain are the ruling conducts of human life in the psychological sense. He added that the human beings constantly seek to maximize the amount of happiness and exterminate the amount of pain. More importantly, utilitarianism argues that the moral worth of any action should be determined through the degree to which that action creates the “greatest good for the greatest number of people” (Andryszewski, 2007). Interesting here to note is that, unlike many other moral theories, utilitarianism does not provide a straight forward answer to the morality or immorality of gay marriage but it leaves the decision on certain other factors.
