Jim, who is 59 years old, has recently walked out of his job as a lorry driver. He did this because his employer accused him of stealing goods he was transporting. Jim had worked in the job for 12 years and was paid a weekly wage of £420. Explain what Jim will need to prove in order to claim unfair dismissal and advise him on his entitlements if he was found to have been unfairly dismissed.

No one should suffer unfair treatment at work because it is called discrimination, Unfortunately, the unequal treatment occurs in many workplaces throughout the United Kingdom, and too often, employees do not know where to turn with concerns that can affect their professional life. What's more, the economic climate of United Kingdom is very fragile, and majority of people are focusing on saving their jobs instead of losing it. Therefore, they are afraid to speak up or take stance against what they believe to be unfair dismissal from work (Holland and Burnett, 2008).

As far as the case of Jim is concerned, the position of stance of Jim was very weak because the employer has furnished a justification for his dismissal which is also mentioned above. If by obtaining support form laws regarding unfair dismissal it is clear that Jim cannot prove his innocence whereas, the employer do not need to furnish any evidence because he might have assume this after checking the records and may be someone else had steal the products from the lorry. However, Jim can ask for compensation instead of reinstatement, filing such a petition will loosen the grip of employer over the case and in such petition he had to furnish concrete evidence for firing Jim.
