The background of the case

The case deals with the government abuse, as well as, the contradiction between the powers of the US Supreme Court and the US Congress, the case dealt with an abusive use of government powers used by Marinda Warming. The case emerged from the legal premise of Supreme Court law that the statements that are made by the criminals while they are in custody are essential to be confirmed through the interrogation. These statements are to be confirmed prior to their presentation with the court of law, and the relevant preceding of the case has to be carried after the acceptance of the suspect regarding the statements.

The court therefore implied that the idea behind the interrogation is a bit harsh, and therefore, the development of a new notion took place. In the former case, it was essential for the criminal to agree and accept the statement of the words, and therefore, he is further held accountable for the court on the part of the crime, as well as, the statements accepted in the interrogation. The court has altered it now, and the process of interrogation has become less intent due to the emphasis of the international and state law upon criminal justice. The court has now allowed the criminal or suspect to remain silent in the process of interrogation, and therefore, the police has no right to force them regarding the silence. The court would merely account the criminal for the statements that are accepted to be on his account, and therefore, the court has to distinguish the criminal from a suspect merely on what falls on his account. The amendment is known as 'Marinda decision' that was passed by the court of law in the year 1968 (The University of Washington, 1999).
