Introduction

There is an on-going debate among medical health professionals that shall they give priority to medical knowledge of a patient and/or the guardians over the legal requirements of obtaining consent to health care (Abelson et al, 2003). This paper in this relation is going to present critical argument related to the subject, while maintaining the position that legal and ethical principles must be followed regardless of the nature of the case. Areas that this discussion will cover include ethical Principles (values/virtues), the promotion of benevolence and care, the avoidance of harm to ensure justice and kindness, the need for honesty, primary loyalty to patient consolation, respect for human dignity gentleness and the principle of double effect.

Around the globe, concern has been raised the in-spite of ever-increasing range and superiority of healthcare services, the enormous funds dedicated to it continual focus on enhancing the services, and all these efforts have sill not proved their due worth. futher the basic and fundamental aspect of health care delivery that comprises of caring and devotion, and th role of human has still been questioned.

In relation to the subject of debate, two different approaches are being followed by medical and healthcare personnel and other concerned individuals and organization. The consideration of ethical principles merits the mentioning of the fact that there are people who believe that a medical practitioner based upon the knowledge and expertise can take better decision regarding the selection of medical care (Musson & Helmreich, 2004). With regard to the avoidance of harm and the provision of justice and kindness, it merits highlighting that the latter approach is backed by empirical researches and in fact legislation also exists in this context giving the rights to the parents and / or guardian to make decision regarding the medical treatment(Ng et al, 2006).

I also endorse the latter approach, as if a person is not mentally prepare to take on a specific medical treatment, than there is a likelihood that he or she may not participate in the recovery process which will developed negative effects on the health of the individual.
