Introduction

The purpose of this study is to expand the boundaries of our knowledge by exploring some relevant facts and figures relating to the topic of criminal law. In this paper the author has examined the case, in which John, who lives next to a school and is very concerned about the danger posed by parents parking all along the road (and particularly outside his house), whilst they drop off and pick up their children from school. This section highlights the key concerns of the case to be analyzed that relates it to a criminal offense. The scenario presented for analysis engulfs the conceptions of criminology that is incorporated in order to provide proper guidance to the individual seeking guidance in the case. The primary purpose of this study is to ascertain whether or not John's actions in erecting the sign might constitute a criminal offence. In the next section the author will provide an explanation of the research methodology, which should show how located relevant legislation, cases and journal articles are located. Furthermore, advice will also be given regarding John's concern about the danger posed by parents parking all along the road and his decision of erecting the sign. The next section of the paper will analyze the case and its each and every dimension for effective advice to be provided to John.

Analysis of the Case

The case is related to the illegal parking of the vehicles in front of John's place. John lives next to a school and is very concerned about the danger posed by parents parking all along the road (and particularly outside his house), whilst they drop off and pick up their children from school. He has tried several things in the past to stop the parents from doing this, such as photographing the number plates of the offending vehicles and putting the photos on the village notice-board, and alerting the local authority, who have, on several occasions, sent a traffic warden to issue tickets to those who are parked on the prohibited space outside of the school entrance.

John now wishes to erect a sign warning drivers of the dangers of parking so close to the school gates. He has had the sign made, at quite an expense to himself, and now wishes to put it up. The place which he has chosen to put it up is in the corner of his front garden, and will mean that it has maximum effect, as it will be clearly visible to all drivers approaching the school, although it will mean that the “danger children crossing” sign will no longer be visible to drivers. One of his friends has suggested that this may cause a danger to road users and has advised John to seek permission to erect it.
