Case 1:

Alice's twin brother, Philip, had an equitable interest in Dream House and used to stay at the bungalow nearly every weekend when he needed a break from his stressful life as a stockbroker in the City of London.

As no information been provided in this case regarding the fact that whether or not, Alice's twin brother, Philip had any legal share in the property or not, therefore, in order to deal with this case, the case has to be studied from two different points. The two different points that have to be considered in solving this case would be that if Philip had a legal share in the property, what should done, and the other would be that if Philip had no legal share in the property what would be done.

Considering the first case, if Philip had a legal share in the property, then he had the right to make a claim for the sale of the property by his twin brother, Alice, without informing him. If such was the case, then it can be said that the deal of sale purchase that took place between Brian and Alice would be cancelled and the amount Brian had paid would returned to him. Furthermore, it can also be said that if such was the case, than Brian also had the right to make a claim for the property, as he has legally paid the amount to Alice and purchased the property.

Considering the other point in this case, it can be said that if Philip had no legal share in the property than he had no right to claim. The property would then be transferred to Brain, who had legally purchased it by paying the amount to Alice. Furthermore, the title would then be transferred to Brain, as he would be the legal owner of the property then.

Case 2:

Barbara, a friend of Alice whom she met at work, claim that Alice granted her a lease of the annexe in July 2011 and that the lease was due to commence on November 5, 2011, which is when Barbara had to leave her previous accommodation.

In order to answer the case, two things are to be considered. The first to beconsidered here is that whether or not Alice had signed a legal agreement with Barbara, regarding the lease that Barbara is claiming for.
