Challenges in the Dual role of Mediation and Advocacy
Introduction
The mediator is the neutral and sometimes called the third party who makes arrangements end the conflict between the two parties (Alabama Center for Dispute Resolution, 2007). In this regard, (s) he facilities the communication between the two parties and keep it secret. The final decision always made by the parties. On the other hand is the advocate; it is the professional lawyer who pleads the case of client before the tribunal or any other judging authority. The advocates put all their energies to defend the case of client. For this, they take the help of different logic, tricks, information and sources. The problem arises when an advocate becomes the mediator or vice-versa. In this paper, the light will be put on the integration of these professions and challenges in the dual role.
My Opinion in the light of Human Service Field
The theme of human service is to make things easy for the cause of society and people. In the legal domain, they are the advocates and mediators which are working to resolve the complex public and private issues. The solution of these issues is in the interest of people and society at a large. Most of the common people are not aware of the laws and regulations which are protecting their rights. They do not know how to resolve the thorny problems. In the same way, mediators bury the hatchets between or among the parties. Like the advocate, mediation is the professional and specialized field. At the local level, their presence is common in the society. However, at the international level there are so many international agencies which are facilitating to resolve the cases.
