Week 5

The scenario evidently suggests that the a verbal agreement was entered into between the client and the real estate agent in which the real estate agent offers her assistance in obtaining a foreclosed property for the client in return for some consideration. Consequently, the real estate agent manages to obtain a check of $5000 from the client. An agreement when taken place between two competent parties who freely consent to enter into the agreement and intent to create legal relationship in return for legal consideration becomes a contract legally enforceable by law (Pentony et al., 2013). The agent made an offer and it was accepted by the client. Even though its verbal, it is legally enforceable and binding on both parties. The client has suffered monetary loss and it is advisable to sue for damages. JNOV is a practice whereby the judge not withstands the judgment of the presiding jury and reverse or attempts the verdict. This however comes into play only in cases when the decision of the jury is extreme or unreasonable.

Week 6

The written agreement with the tour bus company is a binding contract which includes availability of motor coach for transportation to the Supreme Court, meeting with members of supreme court, a lunch and a promotional jacket for each student indicating their membership to the Kenny Charlie law club.

For these services each student had paid a consideration of $100. However, it is evident from the scenario that there has been a breach of contract. The tour bus company failed to provide the bus on time and also when the bus arrived it was found that it was defective. Consequently, the students missed the meeting with the justices, the luncheon could not be provided on time, and also the jackets had the misspelled name of the club. The tour bus company is liable for the damages. It maybe be sued for the breach of contract, the damages and also the loss suffered by the students. The loss and damages can be compensated by a penalty imposed on the tour bus company along with another trip providing the same services and arranging the missed out meeting with the justices.
