Under U.S. law, intellectual property is all kinds of creativity, such as inventions, literary or artistic works and symbols, names or marks used in industry and commerce. Intellectual property law is divided into two categories.

Copyright (Copyright), in which there are:

Literary works, short stories, poems, plays, movies

Musical works

Works of art such as drawings, paintings, photographs, sculptures, architectural drawings

Industrial property, which include:

Patents for inventions

Trade marks

Geographical indications

Protection of industrial property law, like any other proprietary right, guarantees the creator or owner of the patent, trademark or copyright, the right to dispose of and to benefit from his work or invention. This means that this specific group of owners has obtained similar legal instruments to protect their property enjoyed by the holders of such items of property as a car or apartment. U.S. copyright law (American Copyright Act 1976) gives the creator the exclusive right to dispose of his work in taking the decision:

Reproduction of the work - copy

Execution of derivative works based on original work

Distribution of copies, by selling, renting, leasing, etc.

Play or presentation public works

The accepted legal practices (not legal initiatives, it is proposing rules to give them different effect) as described also undermines the very foundations of the State, because it exists for the protection of individual liberties, fundamental rights of individuals facing toward the common good and social peace. Such laws threaten the state itself so seriously that mechanisms should declare unconstitutional jurisdiction, as well as infringing international conventions on human rights (Thome, Ferrell, 2010).
